fthetreatyformthefoundationfortheinterpretiveprocess:“interpretationmustbebasedabovealluponthetextofthetreaty”.InconsistencewithsuchguidelinesforinterpretationaswellasestablishedGATT/WTOpractice,bothpanelsandtheAppellateBodyshouldnotcreatetheirowninterpretativeprinciplesisolatingfromtherulesoftreatyinterpretationsetoutintheViennaConvention,andmustnotaddtoordiminishrightsandobligationsprovidedintheWTOAgreement.
　　Inaword,theapplicationoftheserulesinArt.31oftheViennaConventionwillusuallyallowatreatyinterpretertoestablishthemeaningofaterm,evenifafterapplyingArt.31themeaningofthetermremainsambiguousorobscure,orleadstoaresultwhichismanifestlyabsurdorunreasonable,Art.32allowsatreatyinterpretertohaverecourseto“supplementarymeansofinterpretation,includingthepreparatoryworkofthetreatyandthecircumstancesofitsconclusion”.
