“相互性”是以利益边界的划分或说产权的界定为前提的，显然，如果双方的产权未确定，那么，法律权威对产权的裁定便不存在取消一方的权力而转移给另一个问题，而科斯“零成本交易”设想正忽视了这个逻辑。例如，假若A与B都对某物持有一定权力，若法律取消了A的这项权力，就意味着这项权力转移给B，其后果是B的占有意味着A的牺牲和损失。在村庄中由于村支书与村主任都拥有村庄治理权，二者对村权认知上也是合情合理的，但由于法律界定不明确，表明村支书对村权的占有意味着村主任的损失，村主任对村权的占有意味着村支书的损失，出现产权、占有和认知的矛盾，从而无法谐调共事。

 Games of Elites , the State of Inferior Paralysis  and  Village  Public Governance  

Abstract: This thesis tries to use the analytical frame of Game theory against the background of G country in HuNan Province to observe and analyze the elite competitive mechanism and political goings in a village. The author points out that because of lacking autonomic mechanism and in short system supply , during the games government inside and outside of the system between goverrment elites and Non-governmental elites in a village as well as between village secretary and village diretory of government elites , there are some behaviour deviations among the government elites 、Non-governmental elites 、small-town government and common villagers。In fact , the village public government is in a state of inferior paralysis。So if we want to chang the state，we must abide by the following principles：First，clear the duty and right and establish coordination blance system in Party branch Committee and Villager’s Committee; Second , broaden irrigation ditch and improve the Non-governmental elites adopting mechanism ; Third , widen villager’s joining and strengthen their supervising mechanism ; Forth , conforming the actions and establishing arbitration mechanism in the government of the small-town 。
