inesemodeofthinking,whichisonthesamebasisastherepealedsystemofguiltyanalogy. iii.PhenomenonandsituationofcybercrimeinChina Inthefieldofnetwork,Chinaisanup-and-comingyoungster.Now,thenetworkinChinaisdevelopingwithirresistibleforce.Asforwhetheritwillbeconfrontedwithabottleneckatacertainextent,that’sthetopicofotherinterests.Themomentumnowisinevitablyembodiedwiththegradientsofexaggerations,andhasthefactorofnetworkbubble.Idonotsharethecommonideaswiththosewhoareunrealisticallyoptimistic,becausepeopleinthevastruralareasrestrictedbyfinancialconditionsintheprocessofpossessingcomputerandaccessingtothenetwork.It,however,begantotakeshape.Underthesecircumstances,networkposesproblemsinChinesesocietyandChineselegalsysteminmanyways.Cybercrimeandthenetworkarecloselyassociatedwitheachother.Themorepopularisedthenetwork,thehigherpossibility,probabilityandtherateofoccurrenceofcybercrime.Ifthecrimeinthesocietyalsoabidesbytheruleofsaturation,theincreaseofthecrimewilltosomeextentbeaportionofthetotalcrimes,butnotaggrandiseindependentlysinedie.Othercrimeswilldecrease. Thegroupofpotentialcriminals,opportunitiesforcrimeandthesituationofcrimearebasicallystable;cybercrimeisliketraditionalcrime,deservespunishmentandprevention,butnothatredandextermination.Thesocialhistoryhasalreadyprovideduswithinstancesforpossiblereference.Chineselegislatureandgovernmentshouldtreatandhandletheproblemofcybercrimeinaordinarystateofmind,keepingcalmandreasonable,butnotbeingflustered,confused,asiffacedwithaformidableenemy,hasfleeingarmy’ssuspicionofdangerattheslightestsound,allgrassandtreesaremistakenforenemytroops. Makingacomprehensivesurveytothedevelopingtendencyofcrimeinthemaincountriesintheworldinrecentyears,inthecontextofrapidexpansionofthenetwork,thetotalsumofcrimedoesnotincrease,otherwise,itdecreases,forexample,intheUSA,UK,Canada,German,France,theNetherlands,Denmark,Ireland,etc(Insomeothercountries,increased).Thisfurthershowsthattheresourcesofcrime,includingcriminalhumanresources,withinacountryandallovertheworldareaslimitedasthatofeconomy. Fromlate1990s,besidestheorganisedcrimeandsoforththatattractscommonattention,cybercrimeisgettingrampant.Itisjustthethirdmodeoftherelationship.Now,itisintheperiodwhenthefieldsofcriminalinvestmentandthatofthecapitalinvestmentcoincide.Here,theso-calledinvestment,shouldberegardedassupplementaryinvestment.Theincreaseofthecriminalinvestment,theincreaseofthecapitalinvestment,theprocessoftheincreasesynchronises.
