Moreover,thisbookisintendedtobedescriptiveandpositiveratherthanprescriptiveandtheoretical.Mostoftheauthor’sanalysisbenefitsmuchfromthepreciseandlogicallyorganizedreportsbypanelsandtheAppellateBody,administeredbytheDSBundertheWTOjurisdiction.Itmustbemadeclearthatthesereportsdonotconstitutebinding“subsequentpractice”referredtoinArticle31oftheViennaConventionontheLawofTreaties,nordotheyoperateasstaredecisis,panelsandtheAppellateBodyarethereforenotboundbypastreports.Nevertheless,itdoesbethecasedemonstratedbytheDSBpracticethat,relevantreasoninginaparticularcasehasbeencitedorfollowedfrequentlybyanotherpanelorconfirmedbytheAppellateBodyinsubsequentcases. AsruledbytheAppellateBodyinJapan-TaxesonAlcoholicBeverages(DS44),“[a]doptedpanelreportsareanimportantpartoftheGATTacquis.Theyareoftenconsideredbysubsequentpanels.TheycreatelegitimateexpectationsamongWTOMembers,and,therefore,shouldbetakenintoaccountwheretheyarerelevanttoanydispute”.Furthermore,apanelcouldneverthelessfindusefulguidanceinthereasoningofanunadoptedpanelreportwhenitconsidersrelevant.Moreimportantly,asstatedintheletterwithwhichtheAppellateBodyconveyedintheFebruaryof1996itsWorkingProceduresforAppellateReviewtotheDSBforinformation,“…itisalsoimportanttoensureconsistencyandcoherenceinourdecision-making,whichistotheadvantageofeveryWTOMemberandtheoverallmultilateraltradingsystemweallshare”. Thereisnodoubtthat,inlinewiththepragmaticevolutionoftheGATTdisputesettlementsystem,theprogressiveclarificationofanumberofissuesthatarenotpreciselyregulatedintheDSUandthefurtherdevelopmentoftheWTOdisputesettlementprocedures,willgraduallyevolveafterhavingbeentestedandprogressivelyclarifiedandimprovedinconcretedisputesettlementcases.
